Introduction

We prefer to believe that, most of the time, most people are pretty reasonable. We just find life is easier that way! And we try to run our business based on that belief.

So, when writing these terms and conditions with the help of our lawyers, we've tried to avoid using too much legal language, and kept things as short, understandable and simple as we can.

Okay then. Here we go….

General

When you purchase a book package from Art Eater (we've also described ourselves in this document as ‘we', ‘us' or ‘Art Eater') you the customer (who we also describe as ‘you') are also agreeing to what we've set out below - our terms and conditions of use (also described as ‘Terms'). 

If you don't agree with the Terms, then hey - you probably shouldn't purchase from us!

We may need to change some of these Terms now and then, so do check this part of the site every so often. By continuing to use us, you agree to the revised Terms.

Book package purchased first

You must purchase at least one of the three book packages before you can purchase any of our other non-fundraising products. We set out our reasons for insisting on this in the FAQs.

What we will reproduce and what we won't

We'll always try to the best of our ability to capture digitally every piece of artwork you send us, provided it fits in the Art Eater artbag and is within the limits of the package you have purchased. However, sometimes certain pieces of three-dimensional artwork, or artwork including glitter or other reflective material, may not reproduce as successfully as we - or you - would like. In these cases, you understand that the result that we will present to you will be - in Art Eater's opinion- the best achievable with that piece of artwork and our specialized equipment. You also understand that this is the reason we allow up to 50 pieces of artwork to be digitized for a 40-image book, 70 for a 60-image book and 90 for an 80-image book.

Faithfulness of reproduction

Although we take every care with our digital capture and printing processes and are very proud of the results, there will sometimes be a slight variation in colours between original and printed images. This is unavoidable, and you agree not to hold us responsible for any such variations, should they occur.

Copyright on submitted pieces

We're dealing with original artwork here, so copyright is unlikely to be a regular problem. Nevertheless, we do still have to deal with it in our Terms. Obviously we can't reproduce or capture anything that is subject to copyright without permission of the owner. When you send us your artwork you are granting us permission to reproduce the images for the purpose of delivering the Art Eater service to you. If there is any other dispute over copyrighted imagery, we reserve the right to remove the artwork in question from our site.

Keeping your images

Once you have been given your username and password by us, you can access your images and order products on our site for up to one year. We will e-mail you before we take them down. We will hold the high-resolution imagery securely at Art Eater for the same period of time.

Limited liability

As part of our service, we need to send your artwork and other goods by post. The artwork, whilst of no commercial value, is clearly very important to you and your child. Therefore we provide you with our own robust protective art box and protective bag, offer tracking of the packages via e-parcel and take every other reasonable care to ensure the artwork is protected. However, we cannot accept responsibility for loss or damage during transit, or loss or damage as a result of insufficient or careless packing by anyone other than ourselves, or loss or damage through circumstances beyond our control.

Copying our material and software

Our systems, processes and HTML code, the Art Eater name and logo and all other content, information and services we offer are protected under Australian and foreign copyright and trademark laws.

Privacy policy

We will need to collect some personal information from you for the purposes of setting up your account with us and providing our service to you. We will only ever use this information strictly in accordance with our privacy policy. And don't worry - we hate spam as much as you do.

Unsolicited ideas

We welcome your feedback at all times. Please be aware though that if you want to send us unsolicited commercial ideas for our business, then the ownership of those ideas passes to us once you have sent them. So, if you have a commercial idea you would like to discuss with us, then contact us describing it in general terms only. We can then get our lawyers involved in the discussion if it is something we are interested in pursuing.

Cancellation and replacement policy

We begin producing your material as soon as an order is received, and so cancellations cannot be made or refunded. Replacements will only be made for orders suffering defects of manufacture, provided that you return the affected product to us within 14 days of receipt. If you believe you have a faulty product, please e-mail us at quality@arteater.com.au.

Products subject to customer-generated errors, such as spelling or grammar mistakes, or images reproduced upside-down where we have not been notified, will not be replaced free of charge.
